1. Acceptance of Terms

By accessing or using SocialHub ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and SocialHub regarding your use of our social media management platform. You represent that you are at least 16 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

SocialHub is a social media management platform designed for retail stores and businesses. Our Service includes:

  • AI-Powered Content Generation: Suggestions and templates for social media posts tailored to your business
  • Post Scheduling: Schedule and automate posts across multiple social media platforms
  • Multi-Platform Management: Connect and manage Facebook, Instagram, and LinkedIn accounts
  • Analytics Dashboard: Track engagement, reach, and performance metrics
  • Content Calendar: Visual planning and organization of your social media content
  • Team Collaboration: Invite team members to collaborate on content creation
  • Image Library: Upload and manage images for your posts

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible.

3. Account Registration and Security

3.1 Account Creation

To use SocialHub, you must create an account by providing accurate and complete information, including your store name, email address, and a secure password. You agree to keep this information current and accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • Use a strong, unique password
  • Not share your login credentials with others
  • Notify us immediately of any unauthorized access
  • Enable two-factor authentication when available

3.3 Account Restrictions

You may not create multiple accounts, use false information, or create accounts for others without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Free Trial

We offer a 14-day free trial for new users. No credit card is required during the trial period. At the end of the trial, you must subscribe to continue using the Service.

4.2 Subscription Plans

We offer various subscription plans with different features and pricing. Current plans and pricing are available on our pricing page. Prices are subject to change with 30 days advance notice.

4.3 Billing

Subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe, and you agree to their terms of service. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then.

4.5 Refunds

Under EU consumer protection laws, you have the right to withdraw from a digital service contract within 14 days of purchase, provided you have not started using the Service. Once you begin using the Service, you acknowledge that you waive this right.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all content you create, upload, or post through SocialHub ("User Content"). By using our Service, you grant us a limited license to store, display, and process your User Content as necessary to provide the Service.

5.2 Content Responsibilities

You are solely responsible for your User Content and must ensure it:

  • Does not violate any applicable laws or regulations
  • Does not infringe on intellectual property rights of others
  • Does not contain false, misleading, or deceptive information
  • Does not include harmful, threatening, or offensive material
  • Complies with the terms of connected social media platforms

5.3 Prohibited Conduct

You may not use SocialHub to:

  • Violate any laws or engage in fraudulent activities
  • Spam, harass, or harm others
  • Distribute malware or engage in hacking
  • Circumvent security measures or access restrictions
  • Scrape or collect data from the Service without permission
  • Interfere with the proper functioning of the Service

6. Social Media Integration

6.1 Third-Party Platforms

SocialHub integrates with third-party social media platforms including Facebook, Instagram, and LinkedIn. Your use of these platforms is subject to their respective terms of service and privacy policies.

6.2 Authorization

When you connect your social media accounts, you authorize SocialHub to:

  • Post content on your behalf according to your scheduled posts
  • Access analytics and performance data from your accounts
  • Retrieve basic profile information from connected accounts

6.3 Platform Changes

Social media platforms may change their APIs or terms at any time, which may affect our Service's functionality. We are not responsible for changes made by third-party platforms.

7. AI-Generated Content

7.1 AI Suggestions

SocialHub uses artificial intelligence to generate content suggestions and post ideas. These AI-generated suggestions are provided as starting points and may require review and modification before use.

7.2 Your Responsibility

You are solely responsible for reviewing, editing, and approving all content before posting, including AI-generated suggestions. We do not guarantee that AI-generated content is accurate, appropriate, or free from errors.

7.3 No Guarantees

AI-generated content may not always be suitable for your specific business or audience. We make no warranties regarding the effectiveness or appropriateness of AI suggestions for your marketing purposes.

8. Intellectual Property

8.1 Our Property

SocialHub, including its design, features, code, and content (excluding User Content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8.2 Feedback

If you provide feedback, suggestions, or ideas about our Service, you grant us a royalty-free, perpetual license to use and incorporate such feedback into our Service without restriction.

8.3 Trademarks

SocialHub and our logo are trademarks. You may not use our trademarks without prior written consent.

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR) and other applicable laws.

By using SocialHub, you consent to the collection and processing of your data as described in our Privacy Policy. You have the right to access, correct, delete, and port your data as outlined in the Privacy Policy.

10. Limitation of Liability

10.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We are not liable for any downtime, errors, or service interruptions.

10.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.3 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

These limitations do not affect your statutory rights as a consumer under EU law, which cannot be waived or limited by contract.

11. Indemnification

You agree to indemnify and hold SocialHub harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content posted to social media platforms through your account

12. Termination

12.1 By You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your subscription will be cancelled and your data will be deleted according to our Privacy Policy.

12.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or fail to pay subscription fees. We will provide reasonable notice before termination unless immediate action is required.

12.3 Effect of Termination

Upon termination, your right to use the Service ends immediately. We will retain your data for 30 days to allow for data export, after which it will be permanently deleted unless required by law to retain it.

13. Modifications to Terms

We may modify these Terms from time to time. Material changes will be communicated at least 30 days in advance via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Service and may request deletion of your account.

14. Governing Law

These Terms are governed by the laws of the European Union and the applicable laws of France. Any disputes arising from these Terms shall be resolved in the courts of France, without prejudice to your right to bring proceedings in your country of residence under applicable consumer protection laws.
